Timeframes apply when lodging a CTP insurance claim. You must lodge a claim form:
- within six months of the date of the accident, or
- in the case of a Nominal Defendant claim, as soon as reasonably practicable after it becomes apparent that the at-fault vehicle in the accident cannot be identified or is unregistered (and therefore uninsured).
If you do not comply with these timeframes, the CTP Insurer or Nominal Defendant may decline to deal with your claim (some exceptions apply; refer to Regulation 4(2) of the Motor Vehicles (Third Party Insurance) Regulations 2013). The CTP Insurer must provide you with information, support and assistance to ensure you are aware of your obligations to comply and give you the opportunity to correct the situation.
